The appeal is in response to a suspension placed on the travel ban by a Seattle Federal Court last week. The administration claimed the activist Seattle judge “overreached” by “second-guessing” the President on National Security.
Acting Solicitor General Noel Francisco, said during the appeal, “The power to expel or exclude aliens is a fundamental sovereign attribute, delegated by Congress to the executive branch of government and largely immune from judicial control.”
